Occupational disease

A disease which was caused by harmful agents in the working environment or by a manner in which the work was performed, specified in a list of occupational diseases, appended to the Ordinance of the Council of Ministers of 30 June 2009 (Journal of Laws 2013, Text 1367).

Benefits in respect of occupational disease are granted based on a decision diagnosing the occupational disease issued by a competent sanitary inspector and a decision of the ZUS evaluating doctor certifying the degree and permanency of body functions impairment resulting in a loss of capacity for work and its connection with the disease.

Rules for awarding and payment of benefits in respect of occupational disease from 1 January 2003 are governed by:

  • the Act of 30 October 2002 on social insurance in respect of accidents at work and occupational diseases (Journal of Laws 2015, Text 1242),
  • the Act of 30 October 2002 on social provision in respect of accidents or occupational diseases occurring in specific circumstances (Journal of Laws 2013, Text 737).
